Terms and Conditions

These Terms of Use (“Terms”) are made between you and Future Currents (“we” or “us”), under which you as an individual user may use www.futurecurrents.org (the “Website”). By using the Website, you acknowledge and agree to the terms and conditions of use set forth below in these Terms:

  1. Use of the Website. The Website allows users to view information, text, data, photographs, audio, video, images, graphics, logos, symbols, documents, and other content, using the Website tools and services. In addition, users can sign up for our email list and communications. 
     
  2. Copyright; Your Use of Content. The Website is protected by copyright as a collective work and/or compilation, under U.S. copyright laws, international conventions, and other copyright laws. The contents of the Website, including content provided by third parties (the “Content”), are only for your personal, noncommercial use. All materials contained on the Website are protected by copyright and are owned or controlled by Future Currents or the provider of the Content. Unauthorized use may violate copyright, trademark, or other laws. To avoid unauthorized use, you:

    • Must abide by any and all copyright notices, information, or restrictions contained in any Content on the Website;
    • May download and make copies of the Content and other downloadable items displayed on the Website only for personal, noncommercial use and you must maintain all copyright notices, credits, attribution and other notices contained in the Content; and
    • May not copy or store any Content for any purpose other than personal, noncommercial, unless you have obtained prior written permission from Future Currents or the copyright holder identified in the individual Content’s copyright notice. 

    You are granted a limited, revocable, and nonexclusive right to create hyperlinks to the Website so long as any links do not portray Future Currents or the creators of any Content in a false, misleading, derogatory, or otherwise offensive manner. You may not use any of Future Currents’ logos, trademarks or other proprietary graphics as part of the link without express written permission, or in any manner that causes confusion. You will not engage with the Website or use any Content in a way that that is unlawful, harmful, offensive, obscene, violent, threatening, harassing, or abusive.
     

  3. Contact Information. In some cases, personal or professional contact information, such as email addresses, of Content creators may be included on papers or publications featured on this Website or in Future Currents’ newsletter or other publications. You will refrain from using this contact information in a way that is unlawful, threatening, harassing, abusive, or offensive, or that would constitute or encourage conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate law. The presence of email addresses on the Website is not an invitation for unsolicited commercial email.
     
  4. Representation and Warranty with Regard to Age. You represent and warrant that you are at least 16 years old.
     
  5. Personal Information. Future Currents’ use of personal information collected from and about you in connection with your use of the Website, including when you provide your email address to sign up for our newsletter, is governed by a Privacy Policy, available here: https://fc-dev.firebelly.co/privacy-policy.
     
  6. No Confidentiality. You acknowledge that transmissions to and from the Website are not confidential and your communications may be read or intercepted by others. You acknowledge that by submitting communications to the Website, no confidential, fiduciary, contractually implied, or other relationship is created between you and Future Currents other than in accordance with these Terms.
     
  7. Enforcing Security. You may not use the Website or any of Future Currents’ data, systems, network, or services to engage in, foster, or promote illegal, abusive, or irresponsible behavior including, without limitation, accessing or using Future Currents’ data, systems, or networks in an unauthorized manner; attempting to probe, scan, or test the vulnerability of Future Currents’ or any of its affiliates’ system or network; circumventing any security or authentication measures, monitoring any data or traffic; interfering with any services; collecting or using from the Website email addresses or other identifiers; using any false, misleading, or deceptive TCP-IP packet header information; using the Website to distribute software or tools that gather information, distributing advertisements; impersonating or attempting to impersonate Future Currents or any of its personnel; or engaging in conduct that is likely to result in retaliation against Future Currents or its data, systems, or network. Actual or attempted unauthorized usve of the Website may result in criminal and/or civil prosecution. Future Currents reserves the right to view, monitor, and/or record activity on the Website in order to maintain security of the Website. Such recorded activity is subject to review by law enforcement organizations. Future Currents will also comply with all court orders, subpoenas, and/or governmental orders involving requests for information. 
     
  8. Changes to the Website. Future Currents may change, suspend, or discontinue any aspect of the Website at any time, including the availability of any Website feature. Future Currents may also impose limits on certain features and services or restrict your access to parts or all of the Website without notice or liability.

     

  9. Term and Termination. These terms apply to your interactions with the Website at all times. If you do not agree to these terms, do not use this Website. 
     
  10. Limitation of Liability. Future Currents is not liable for your use of the Website or any Content contained therein (including without limitation the Content and any errors contained therein). Future Currents is not liable for any damages (including without limitation incidental, consequential, or punitive damages, lost profits, or damages resulting from lost data or business interruption) resulting or arising from your use of, or inability to use, the Website, or sites linked to the Website, whether based on warranty, contract, tort, or any other legal or equitable theory, and whether or not Future Currents was advised of the possibility of such damages. 
     
  11. Indemnification. You will indemnify, defend, and hold harmless Future Currents and its affiliates, and all of their directors, officers, agents, employees, legal advisors, information providers, licensors, and licensees (collectively, the “Indemnified Parties”) from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of any term in these Terms, including without limitation attorneys’ fees and costs. You will cooperate as fully as reasonably required in the defense of any claim. Future Currents reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you may not in any event settle any matter without the written consent of Future Currents.
     
  12. Disclaimer of Warranties. The Website, including all Content, software, functions, materials, and information made available on or accessed through the Website, is provided “as is.” To the fullest extent permissible by law, Future Currents and affiliates make no representation or warranties of any kind whatsoever for the Content on the Website or the materials, information, and functions made accessible by the software used on or accessed through the Website, for any products or services or hypertext links to third parties, or for any breach of security associated with the transmission of sensitive information through the Website or any linked site. Further, Future Currents and its affiliates disclaim any express or implied warranties, including without limitation noninfringement, merchantability, or fitness for a particular purpose. Future Currents does not warrant that the functions contained on the Website or any materials or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the Website or the server that makes it available is free of viruses or other harmful components. Future Currents and its affiliates are not liable for your use of the Website, including without limitation the content and any errors contained therein.

Future Currents does not represent or endorse the accuracy or reliability of any information contained on, or displayed or distributed through, the Website, and Future Currents disclaims any and all responsibility for content contained in any third-party materials provided through links from the Website. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information is at your sole risk. Future Currents reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Website at any time. Any advice, opinion, statement, or other information contained in works or other Content featured on the Website do not necessarily represent the views of Future Currents.
     
  14. Third Party-Resources Disclaimer. The Website contains links and pointers to other related Internet sites and resources and to parties affiliated with Future Currents. Links to and from the Website to third-party sites do not constitute an endorsement by Future Currents or its affiliates of any third-party resources or their contents.

     

  15. Copyright Protection. Future Currents respects the intellectual property rights of others. It is the policy of Future Currents to respond promptly to notices of alleged copyright infringement that comply with the law. Future Currents reserves the right to delete or disable content alleged to be infringing. Potential infringement should be reported per our Digital Millennium Copyright Act (“DMCA”) Policy below.
